Time Tog is the easiest and fastest way to upgrade the quality time of your social life. The owners of Zeitspanne B.V. realized the daily obstacles many individuals face when they want to go out to enjoy something in somebody’s company just for an hour or two.

By creating their online platform Time Tog® 2023 they focused primarily on clearing any communication hurdles preventing a quick and easy contact between individuals with the same availability in leisure time and similar interest on a specific day. The basic idea is to value availability above sympathy, without any need for two individuals to become (online) friends first. The main drive is to facilitate the human need to spend quality time with somebody on an activity of common interest via a real time unique online platform.

II. Terms of Use for Time Tog® application (app) registered users


1. The registration

Before using Time Tog you need to register and/or update accurately your account with name, surname, personal e-mail and date of birth*. The registration is only open to any private (natural) person and remains strictly confidential. Only Time Tog and/or Google LLC staff have access for functional and system required tasks. Google LLC stores the data. We refer to https://policies.google.com/privacy. (* = mandatory)


2. Your Time Tog profile

Your uploaded/edited registered profile appears on Time Tog® map only after you marked your availability for other Time Tog users to be recognized. Your profile contents are:

  • Your profile picture/photo
  • Your name or nickname*
  • Your gender, male/female/other*
  • Your age group*

Please note: With your voluntarily registration you acknowledge, understand, agree and accept, without any restraint or reservation to upload and/or edit as your profile picture neither any nude or pornographic picture or expression, nor any violent or extreme scenes.

In order to respect any other existing copyrights by third parties, do not upload and/or edit any picture, symbol, trademark or photo of any other person other than your own accurate profile picture. With your registration you indicate to be aware and to have accepted our policy of trademark protection under section V.

Any displaying or similar uploaded/edited contents or materials, with the explicit exception of your own accurate profile picture, may violate our display policies and are liable to be removed/deleted by Time Tog® upon first notice and without your prior consent, with an e-mail notification.


3. We reserve all rights to cancel your registered account entirely, put it on hold or shield it, without your prior consent, when you did or intent to violate any of the terms of use. We will notify the Account Owner by e-mail.


4. Account Owner shall mean the accurately registered and accepted account, which is strictly for personal and confidential use by the Account Owner, who accepted these terms of use.

Any knowledge of abuse of your registered user account by the Account Owner, any third party, even beyond the Account Owner’s or Time Tog’s consent, is to be reported without delay.

Multiple user accounts by the same person are not allowed and may be removed upon notification.


5. Time Tog® provides a personalized service that allows her users to upload and access “Time Tog® content” through the Internet under the following Terms of Use which govern the use of the provided services. As used in these Terms of Use, “ Time Tog® service”, “our service” or “the service” shall mean all services provided by Time Tog® for uploading, editing, inserting and searching content filed by the registered users of Time Tog®, including all features and functions of the software applications, the website and user interfaces, as well as all content associated with our services. “Users” shall mean hereinafter the registered natural person who has voluntarily signed up to the Time Tog® application and has been registered and accepted by Time Tog® to be acting as “user”.


6. No Membership

6.1 The use of Time Tog® will continue until the user registration has been terminated. Registrations requirements by Time Tog® are not construed for or intent to start any (legal) fixed membership between user and supplier of Time Tog® whatsoever.

6.2 To use the Time Tog® services requires Internet access and an adequate functioning digital device with Android Operating System not older than 8.0 or the iPhone 12 or higher versions.


7. Time Tog® service

7.1 The user must be 18 years of age, unless the age of majority is higher in the country, province, region or territory of residence to become a registered user of the Time Tog® service.

7.2 The Time Tog® service and any content available through the service are for the registered user’s personal non-commercial use only. The Time Tog® registered user agrees not to use the Time Tog® service for any public performances or infringe any rights of other registered Time Tog® users, parties and/or owners of the Time Tog® services.

7.3 The Time Tog® products and services, including and not limited to the content library, is regularly updated. In addition, Time Tog® keeps on evaluating the various aspects of the services, including the website, user interfaces, promotional features and availability of Time Tog® content.

7.4. a. The registered user agrees not to make and/or distribute any screenshots of Time Tog® displays and neither archive, reproduce, distribute, modify, display, perform, publish, license, create derivative works from, offer for sale, or use (except as explicitly authorized in these Terms of Use) content and information contained on or obtained from or through the Time Tog® products and services.

b. The user also agrees neither to circumvent, remove, alter, deactivate, degrade or thwart any of the content protections in the Time Tog® service; nor to use any robot, spider, scraper or other automated software, device or means to access the Time Tog® services. Neither shall a registered user decompile, reverse engineer or disassemble any software or other products or processes accessible through the Time Tog® service or insert any code or product or manipulate the content of the Time Tog® service in any way or use any current available, running or future developed data mining, data gathering or extraction method.

c. In addition, the user agrees not to upload, post, e-mail or otherwise send, share or transmit any material designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment associated with the Time Tog® service, including any software viruses or any other computer code, files or programs. Time Tog® at its sole discretion may terminate or restrict the use of its services if the user violates these Terms of Use or is engaged in illegal or fraudulent use of the Time Tog® service.

7.5 The quality of the display of the Time Tog® content may vary from device to device, and may be affected by a variety of factors, such as your location, the bandwidth available through and/or speed of your Internet connection.

7.6 The registered user is responsible for all communication, web or phone access charges. Please check with your system/dataprovider(s) for information on data usage charges. The time it takes to use Time Tog® content will vary based on the user data network, the data device/equipment, the user’s location, the actual available bandwidth at the time of use, and/or the content you have selected and the configuration of your Time Tog® ready data device.

7.7 Time Tog® software is developed with all registered rights reserved by, and/or for the Time Tog® company, her owners, designed to enable

researching of Time Tog® content, through the Time Tog® application. This software may vary by device and medium and functionalities and

features may also differ between devices. The registered user acknowledges the use of the service may require third party software, which is

subject to third party licenses. The registered user may receive updated versions of the Time Tog® applications and related third party software.

7.8 Password and Account Access. The Account Owner has access and control over their Time Tog® account to access Time Tog®’s services and is responsible for any and all activity that occurs during the actual time of use through or via the user’s Time Tog® account. The user’s account is secured with the password chosen by the account owner.

To maintain control over the registered user’s account and to prevent any misuse of that account by any other or unregistered use to access the registered user’s account (which may include [but not limited to] information for such unregistered use of that account), the account owner, whether user or not, should maintain adequate control over the account owner’s user devices. The account owner is responsible for updating and maintaining the accuracy of the information provided to its Time Tog® application, relating to the account owner user’s account and the content loaded for others to (re)view.

The legal entity providing and/or hosting the Time Tog® services for the accepted user registration and content, may at its sole discretion, with or without the account owner’s consent, terminate for any reason their user’s account or place that account on hold in order to protect the account owner, other users, Time Tog® and/or its owners or partners from identity theft or other fraudulent activity, for which acts Time Tog® and/or its owners/company will hold and keep holding any infringing person or party, be it the account owner or not, fully liable and responsible under the applicable rulings and laws of The Netherlands.

8. Miscellaneous

8.1 Governing law. These terms of use shall be governed by and construed in accordance with rulings and the laws of The Netherlands. They will not limit any consumer protection rights, that you may be entitled to under the mandatory laws of your country of residence.

8.2 Unsolicited materials. Time Tog® does not accept unsolicited materials or ideas for Time Tog® content and is not responsible for the similarity of any of its content or programming in any media or materials or ideas transmitted to Time Tog®.

8.3 Customer Support. To find more information about Time Tog® services and features or if in need for assistance with a user’s account, please visit the Time Tog® website www.timetog.eu

8.4 Survival. If any provision or provisions of these terms of use shall be held to be (partly) invalid, illegal or unenforceable, the validity, legality and enforceability of all remaining provisions shall remain in full force and effect.

8.5 Changes to terms of use. Time Tog® and/or its parent legal entity may, from time to time, change these terms of use. This will be notified to active registered account owners and users 30 days prior to the effective date of applying such changes.

8.6 Electronic communications. Time Tog® will send registered account owner and user information relating to or about its user account (e.g. changes in password or confirmation).


III. Instruction for smart use of the application Time Tog®


1. The application Time Tog®, hereafter referred to as “Time Tog” or “the app” is a planning tool to arrange social appointments between registered adult Time Tog users only.

2. Please note: This app is not intended to be a digital match-maker or dating application.

3. Proper use of the Time Tog® app enables registered initiating users with their profile to canvas other prior unidentified registered Time Tog® users to decide to visit or participate together in any initiating user defined local activity, accepted by the responding user, in a public area or private area open to the public. An initiating user is the registered natural person by Time Tog®, seeking to invite another unidentified Time Tog® registered user to participate in a local/regional activity. A responding user accepts the (by the initiating user ) proposed activity by entering the chatroom.

4. An initiating user communicates their availability by marking a defined activity. This marking provides detailed information about the indicated availability (description of the activity, place, date, hour) of the initiating user to interact with a Time Tog® user.

The app is meant for users who want to share their quality time in company by going out and do something in their area, their city or in the place they find themselves in. This may be common as having a walk in the local park today or tomorrow; enjoy a drink and chat in the local bar today; visiting a theater nearby this week; playing a badminton match this evening or the day after
tomorrow.

5. Through Time Tog® the initiating user may find another user with similar availability, interests or preferences.

6. The initiating user may define an activity and mark their availability by indicating a location on the map and selecting the start of the proposed activity. The responding registered user can accept and respond to this availability by entering the chatroom with the initiating registered user. The planned activity will now appear occupied on the map. No other responding registered user can enter the chatroom.

7. As indicated under sub 2 the app has not been designed to or is intended to search for new friends or partners. It is primarily intended as a useful tool for users who want to spend available quality time together during a mutually chosen activity.

8. The availability placed on the map will differ by five icons of categories, such as sports facilities (tennis court, ski run), cultural sites (museum, library), bar and restaurants, places to relax (park, beach) and leisure activities (cinema, zoo).

9. The initiating user chooses one of the five icons of activity categories to add to their availability mark.

10. Activities recorded in the Time Tog® app are always to take place in a public area / environment or a private place open to the public, such as exhibitions or concert halls, sport facilities, libraries, museums, parks, theaters, bar, restaurants, zoo, cinemas etc.

11. Use of the Time Tog® app requires the actual geolocation of the user.

12. The app’s chat function will be enabled only after the initiating user has marked to be available for a self proposed activity, after which a responding user may accept it by entering a dialog in the chatroom.

13. The chat function allows users to introduce themselves mutually, to decide to execute the proposed offline activity in more detail.

14. The chat function will expire two hours (120 minutes) from the start of the inserted availability. Upon expiration, update or cancellation of the availability mark, the chat function will be disconnected automatically.

15. In case of update or cancellation of availability marks by the initiating user, the responding user will receive a notification of the disconnected chat. Likewise, when the responding user exits the chatroom, the initiating user will receive a notification.

16. The initiating user may cancel or update availability at any time.

Please note: Time Tog ® will not be liable for any prearranged activities and/or encounters that for any reason do not materialize.


17. Please take good care of your privacy protection.

a. Any personal information, such as telephone numbers, home addresses and/or e-mail addresses, must never be shared and/or exchanged in chats, where the functioning of the app does not require such information to be shared and/or exchanged and is strongly discouraged for the essential protection of your privacy.

b. Interactions between users

  • Unless specifically stated, Time Tog® and/or its owners do not arrange or participate in any of the uploaded (offline) interactions, events, meetings of arrangements announced or activated by its users.
  • Time Tog® does not conduct or is required in any (legal) way to do background checks of the Time Tog® users or is to verify the accuracy and/or quality of the user’s uploads and/or their statements.
  • Nor does Time Tog® and/or its owners make any representations or warranties concerning the usage, conduct or content of any of the users or their interactions with other users.
  • The users of Time Tog® are deemed to use the application prudently and with ample respect for other users. Any user should review with adequate common sense the content of any other user and verify with proper judgement the intentions of the other user(s), before participating in uploaded offline encounters and/or activities.
  • If Time Tog® users have any concerns regarding the prudent and/or respectful usage by other Time Tog® user(s), please report such concerns by clicking the reporting button in the chat function of the app.

IV. Disclaimer


Time Tog® (and/or its parent company) does not belong to any small or major platform party, neither online nor offline, and does not conduct or requires any checks regarding its users. Neither does Time Tog® (or is she required to do so) in any way or at any given moment in time to verify the accuracy of the input by its users. Time Tog® (and/or its parent company) make no representations or warranties regarding the use, conduct or content of any users and/or interactions between users of Time Tog®, whatsoever.

When using the Time Tog® application and/or during interactions deriving from using the app, please make sure to use appropriate care and understanding, with common sense and adequate respect for any other user.

By using Time Tog® registered users do not become (or are intended to become) in any way members of a community or association with any legal objective or motivation. The accuracy and completeness of all website content, texts and links are carefully checked before upload and are regularly reviewed and/or updated. Though for legal and/or property reasons we cannot and do not assume any responsibility, guarantees or liability, that the information provided by and through Time Tog® website is always correct, complete or up to date.

We reserve the right to change the information on this website at any time and without prior notice or consent and do not undertake to update the information contained therein. All links to external providers were checked for accuracy at the time of their inclusion, though we assume no responsibility or liability for the content and availability of other websites, that can be reached via the uploaded hyperlinks. For illegal, incorrect or incomplete contents and in particular for damages caused by the content of linked pages, the provider of the page(s) to which the hyperlinks reference is made is exclusively liable; irrelevant whether the damage is/was of a direct, indirect or financial nature or whether there is any other damage that could result from loss of data, loss of use or other reasons of any kind.

V. Policy of trademark protection


1. The management of Time Tog®, its providers or representatives do not allow and may remove uploaded content that, intended or not, infringes or may infringe on other party’s trademark rights.

A trademark is a word, symbol or combination that is uploaded to identify or represent the source of a good or a service. Once acquired, a trademark gives the owner exclusive rights to the trademark usage with respect to certain good or services. Trademark infringement is improper as well as unauthorized use of an identical or similar trademark in a way that is likely, intended or not, to cause confusion as to the source or ownership of that product or service. If any uploaded content uses another party’s trademarks in a way that is likely to cause confusion, whether intended or not, this content may be deleted or blocked, without any eligibility to (proportional) reimbursement to the uploading party, which party will be held liable for any consequences resulting from such upload.


2. Users shall refrain from mentioning any names, titles or from making any representations, without the prior written approval or consent of the person(s) or entity(ies), with applicable material rights to such names, titles or indicated trademarks.


3. Using a business name or other protected content in a way that may be or is deemed to be confusing or misleading, may constitute a violation of our trademark protection policy.


4. It is though not a violation of our trademark policy to use a business name or logo or other content in a way that is referred to outside the scope protected by the trademark rights. This scope is limited by the geography (such as one or more countries) and products (good and services) covered by the trademark. Neither is it a violation of our policy to make proper fair use of another’s trademark, related information exchanges within the core purpose of our platform operation.


5. As indicated in our Terms of Use, we may in appropriate circumstances and at our sole discretion, remove or disable content or access to content that infringes on the intellectual property or trademark rights of others, and restrict or terminate access to our platform upon repeated infringements. In such case the infringing party or parties will not be eligible to any (proportional) reimbursements and will be held liable for the consequences of such upload(s).

This Privacy Policy outlines Zeitspanne B.V. (“we”,”our/” or “the Company”) practices with respect to information collected from users who download the application Time Tog® and/or access our website at www.timetog.eu, (hereinafter together to be mentioned as our “Digital Products” or “Products”), or otherwise share personal information with us (collectively: “Users”). The user can request to,

  • Receive confirmation whether their personal information is being processed and access their stored personal information, along with additional information.

  • Object to our processing of their personal information.
  • Limit our processing of their personal information.
  • File a complaint with the supervisory authority.

We will keep your personal information for as long as necessary to provide our services and to comply with our legal obligations, resolve disputes and enforce our policies. The retention periods will be determined considering the type of information collected and the purpose for which it is collected, considering the requirements applicable to the situation and the need to destroy obsolete and unused information as soon as possible within reasonable limits. Considering the applicable regulations, we keep records containing customers’ personal data, documents relating to the opening of accounts, communications, and anything else required by applicable law and regulations. We may correct, supplement, or remove incomplete or inaccurate information at any time at our sole discretion.


Legal Basis for Data Collection

Process your personal information (i.e. any information that would enable you to be identified by reasonable means; hereinafter “Personal Information”) is necessary for the fulfilment of our [contractual] obligations towards the user and to provide our services, to protect our legitimate interests and to comply with the legal and financial regulatory obligations to which we are subject.


When you use our products, you consent without any restraint to the collection, storage, use, disclosure, and other uses of your personal information as described in this Privacy Policy. We encourage our users to read the Privacy Policy carefully and use it before making informed decisions.


What information do we collect?

We collect two types of data and information from users.

The first type concerns unidentified and non-identifiable information relating to a user (or multiple users) that may be available or collected using the products (“Non-Personal Information”). We have no knowledge of the identity of a user from whom non-personal information has been collected. Non-personal information collected may include aggregated usage information and technical information transmitted from your device, including certain software and hardware information (for example, the type of browser and operating system your device uses, language preferences, access etc. ) and are used to improve the functionality or our products. We may also collect information about user activity on the products (for example pages viewed, online navigation, clicks, actions etc.).

The second type, Personal Information concerns information that can personally identify a user, i.e. information that identifies an individual or can identify them with a reasonable effort. Such information may include device information. We collect personal information from devices. This information may include geolocation data, IP address, unique identifiers (such as MAC addresses and UUIDs), and other information relating to user activity.


How do we receive user information?

We receive personal information from several sources:

  • When the user voluntarily provides personal data when registering to any of our digital products.
  • When the user uses our products or accesses these in connection with the use of our services.
  • From third-party providers, services, and public registries (for example traffic analysis providers).

How is the information used? Who do we share them with?

We do not rent, sell or share information about users with third-parties except as described in this Privacy Policy.

We may use the information for the following purposes:

  • Communicate with the user – send notices about our services, provide technical information, and respond to any problems with the customer support.
  • Communicate with the user and inform them about the latest updates and services.
  • Conduct analysis and statistics, aimed at improving our products.

  • Prevent damage to the rights, property or safety of us, our customers, users or third-parties; or
  • For purposes of cooperating with law enforcement agencies and/or as we deem necessary to enforce intellectual property or other legal rights.

Cookies

We and our trusted partners use cookies and other technologies in our services, including when you use our products or access our services. A “cookie” is a small text file that a website/mobile application assigns to your device, while you are viewing the website or using the application. Cookies are particularly useful and can be used for different purposes including navigation between pages efficiently, allowing automatic activation of certain functions, remembering preferences and making the interaction between the user and our services easier and faster. Cookies are also used to help ensure that the ads you see are relevant to you and your interests and to compile statistics about the use of our services.


The Products use the following types of cookies

  • Session cookies which are stored only temporarily during a browsing session to allow normal use of the system and are deleted from the device when the browser is closed.
  • Persistent cookies which are read only by the site/application, saved on the computer for a set period and are not deleted when the browser is closed. These cookies are used when we need to identify you to repeat visits, for example to allow us to memorize your preferences for next access.
  • Third-party cookies, set up by other online services, which run content on the page you are viewing, for example by analytics companies that monitor and analyse our web access. 

Cookies do not contain any information that personally identifies you, but the personal information we hold about you may be linked by us to information stored in and obtained by cookies. You can remove or disable cookies by following the instructions in your device preferences, however, if you choose to do so, some features of the site/application may not work properly and your online experience may be limited.


We use a tool that is based on Snowplow Analytics Technology to collect information on the use of the site. The tool collects information such as how often users access the site, which pages they visit when they do so, etc. The tool does not collect any personal information and is used only by our site management and site hosting service provider to improve its site and its services. 

In order to present our content correctly and graphically pleasing in all browsers, we use script libraries and font libraries such as Google WebFonts (https://www.google.com/) on our website. Google Web Fonts are transferred to the browser cache to avoid being loaded multiple times. 

If your browser does not support Google Web Fonts or does not allow access, the contents will be displayed in a default font.

  • Using script or font libraries automatically activates a connection with the library operator. In theory, it is possible – but currently not clear whether, and if so, for what purpose – that such operators of the corresponding libraries collect data.

Third Party Information Collection

Our policy only concerns the use and disclosure of the information collected from the user. To the extent that you disclose your information to other parties or sites/applications on the Internet, different rules may apply to the use and disclosure of the information you disclose to them.

Accordingly, we encourage users to read the terms and conditions and privacy policy of each third party to whom they choose to disclose their information. This Privacy Statement does not apply to practices of companies we do not own or control, or individuals who do not work for us and that we do not manage, including third parties who may disclose information as set forth in this Privacy Statement.


How do we take care of the information?

We take great care in implementing and maintaining the security of the products and user information. We have arranged industry standard policies and procedures to ensure the security of the information we collect and maintain, we prevent unauthorized use of such information, and we require any third party to comply with similar security requirements, according to this Privacy Police.


While we take all realistic and reasonable steps to safeguard your information, we cannot be responsible for the acts of those who gain unauthorized access to or misuse our site/application, and we make no warranties, express, implied or otherwise, that we can prevent such access.


Data transfer outside the European Economic Area

Note: Some data recipients may be located outside the European Economic Area. In that case, we will only transfer data to countries approved by the European Commission as offering an adequate level of data protection or enter into legal agreements to ensure an adequate level of data protection.


Corporate transaction

We may share information in the event of a corporate transaction (such as the sale of a sizeable portion of our business, a merger, consolidation or asset sale). In such event, the assignee or acquiring company will assume the rights and obligations as described in this Privacy Policy.


Minors

We understand the importance of protecting children's privacy, especially in an online environment. Under no circumstances do we allow minors to use our services without the prior consent of a parent or legal guardian. We do not knowingly collect personal information from minors. If a parent or guardian becomes aware that the child has provided us with personal information without their consent, they should contact us at info@timetog.eu with subject: Data Protection of Minors.


Updates or changes to this Privacy Policy

We reserve the right to periodically change or revise the Privacy Policy; material changes will be effective immediately upon viewing the updated Privacy Policy. The latest revision will be reported in the “Last modified” section. Your continued use of our digital products following the service notice of such changes represents your acceptance and consent to such changes to the Privacy Policy and your consent to abide by their terms.
